Zulfiqar Ali Bhutto

Zulfiqar Ali Bhutto was born on January 5, 1928. Before his birth he had two brothers: The first one Sikandar whom Z. A. Bhutto never saw as he fell victim to Pneumonia when he was only seven in 1914 and the second one Imdad Ali who also died of Cirrhosis of the lever at the age of 39 in 1953. Zulfiqar Ali Bhutto completed his early education from Bombay's Cathedral High School. In 1947, he joined the University of Southern California, and later the University of California at Berkeley in June 1949. After completing his degree with honors in Political Science at Berkeley in June 1950, he was admitted to Oxford.
Zulfiqar Ali Bhutto married Nusrat Isphahani on September 8, 1951. He was called to Bar at Lincoln's Inn in 1953, and the same year his first child, Benazir Bhutto, was born on June 21. On his return to Pakistan, Bhutto started practicing Law at Dingomal's.
In 1958, he joined President Iskander Mirza's Cabinet as Commerce Minister. He was the youngest Minister in Ayub Khans Cabinet. In 1963, he took over the post of Foreign Minister from Muhammad Ali Bogra.
His first major achievement was to conclude the Sino-Pakistan boundary agreement on March 2, 1963. In mid 1964, Bhutto helped convince Ayub of the wisdom of establishing closer economic and diplomatic links with Turkey and Iran. The trio later on formed the R. C. D. In June 1966, Bhutto left Ayub's Cabinet over differences concerning the Tashkent Agreement.
Zulfiqar Ali Bhutto launched Pakistan Peoples Party after leaving Ayub's Cabinet. In the general elections held in December 1970, P. P. P. won a large majority in West Pakistan but failed to reach an agreement with Sheikh Mujib-ur-Rahman, the majority winner from East Pakistan. Following the 1971 War and the separation of East Pakistan, Yahya Khan resigned and Bhutto took over as President and Chief Martial Law Administrator on December 20, 1971.
In early 1972, Bhutto nationalized ten categories of major industries, and withdrew Pakistan from the Commonwealth of Nations and S. E. A. T. O. when Britain and other western countries recognized the new state of Bangladesh. On March 1, he introduced land reforms, and on July 2, 1972, signed the Simla Agreement with India, which paved the way for the return of occupied lands and the release of Pakistani prisoners captured in East Pakistan in the 1971 war.
After the National Assembly passed the 1973 Constitution, Bhutto was sworn-in as the Prime Minister of the country.
On December 30, 1973, Bhutto laid the foundation of Pakistan's first steel mill at Pipri, near Karachi. On January 1, 1974, Bhutto nationalized all banks. On February 22, 1974, the second Islamic Summit was inaugurated in Lahore. Heads of States of most of the 38 Islamic countries attended the Summit.
Following a political crisis in the country, Bhutto was imprisoned by General Zia-ul-Haq, who imposed Martial Law on July 5, 1977.
On April 4, 1979, the former Prime Minister was hanged, after the Supreme Court upheld the death sentence passed by the Lahore High Court. The High Court had given him the death sentence on charges of murder of the father of a dissident P. P. P. politician.

NRO Short Order by Supreme Court of Pakistan

The following Short Order has been cited and reproduced as given by the Hon'ble Supreme Court of Pakistan.
........Promulgation of the NRO seems to be against the national interest and its preamble is contrary to the substance embodied therein. Thus, it violates various provisions of the Constitution. Therefore, by means of instant short order, reasons of which shall be recorded later, we hold as follows:-
(i) that the NRO is declared to be an instrument void ab initio being ultra vires and violative of various constitutional provisions including Article Nos. 4, 8, 25, 62(f), 63(i)(p), 89, 175 and 227 of the Constitution;
(ii) that as a consequence of the said declaration, all steps taken, actions suffered, and all orders passed by whatever authority, any orders passed by the courts of law including the orders of discharge and acquittals recorded in favour of the accused persons, are also declared never to have existed in the eyes of law and resultantly of no legal effect;
(iii) that all cases in which the accused persons were either discharged or acquitted under Section 2 of the NRO or where proceedings pending against the holders of public office had got terminated in view of Section 7 thereof, a list of which cases has been furnished to this Courtand any other such cases/proceedings which may not have been brought to the notice of this Court, shall stand revived and relegated to the status of pre-5th of October, 2007 position;
(iv) that all the concerned courts including the trial, the appellate and the revisional courts are ordered to summon the persons accused in such cases and then to proceed in the respective matters in accordance with law from the stage from where such proceedings had been brought toan end in pursuance of the above provisions of the NRO;
(v) that the Federal Government, all the Provincial Governments and all relevant and competent authorities including the Prosecutor General of NAB, the Special Prosecutors in various Accountability Courts, the Prosecutors General in the four Provinces and other officers or officials involved in the prosecution of criminal offenders are directed to offer every possible assistance required by the competent courts in the said connection;
(vi) that similarly all cases which were under investigation or pending enquiries and which had either been withdrawn or where the investigations or enquiries had been terminated on account of the NRO shall also stand revived and the relevant and competent authorities shall proceed in the said matters in accordance with law;
(vii) that it may be clarified that any judgment, conviction or sentence recorded under section 31-A of the NAB Ordinance shall hold the field subject to law and since the NRO stands declared as void ab initio, therefore, any benefit derived by any person in pursuance of Section 6 thereof is also declared never to have legally accrued to any such person and consequently of no legal effect;
(viii) that since in view of the provisions of Article 100(3) of the Constitution, the Attorney General for Pakistan could not have suffered any act not assigned to him by the Federal Government or not authorized by the said Government and since no order or authority hadbeen shown to us under which the then learned Attorney General namely Malik Muhammad Qayyum had been authorized to address communications to various authorities/courts in foreign countries including Switzerland, therefore, such communications addressed by him withdrawing the requests for Mutual Legal Assistance or abandoning the status of a Civil Party in such proceedings abroad or which had culminated in the termination of proceedings before the competent fora in Switzerland or other countries or in abandonment of the claim of the Government of Pakistan to huge amounts of allegedly laundered moneys, are declared to be unauthorized, unconstitutional and illegal acts of the said Malik Muhammad Qayyum;
(ix) that since the NRO stands declared void ab initio, therefore, any actions taken or suffered under the said law are also non est in law and since the communications addressed by Malik Muhammad Qayyum to various foreign fora/authorities/courts withdrawing the requests earliermade by the Government of Pakistan for Mutual Legal Assistance; surrendering the status of Civil Party; abandoning the claims to the allegedly laundered moneys lying in foreign countries including Switzerland, have also been declared by us to be unauthorized and illegal communications and consequently of no legal effect, therefore,it is declared that the initial requests for Mutual Legal Assistance;securing the status of Civil Party and the claims lodged to the allegedly laundered moneys lying in foreign countries including Switzerland are declared never to have been withdrawn. Therefore the Federal Government and other concerned authorities are ordered to take immediate steps to seek revival of the said requests, claims and status;
(x) that in view of the above noticed conduct of Malik Muhammad Qayyum, the then learned Attorney General for Pakistan in addressing unauthorized communications which had resulted in unlawful abandonment of claims of the Government of Pakistan, inter alia, to huge amounts of the allegedly laundered moneys lying in foreign countries including Switzerland, the Federal Government and all other competent authorities are directed to proceed against the said MalikMuhammad Qayyum in accordance with law in the said connection;
(xi) that we place on record our displeasure about the conduct and lack of proper and honest assistance and cooperation on the part of the Chairman of the NAB, the Prosecutor General of the NAB and of the Additional Prosecutor General of the NAB, namely, Mr. Abdul BaseerQureshi in this case. Consequently, it is not possible for us to trust them with proper and diligent pursuit of the cases falling within their respective spheres of operation. It is therefore, suggested that the Federal Government may make fresh appointments against the said posts of persons possessing high degree of competence and impeccable integrity in terms of Section 6 of the NAB Ordinance as also in terms of the observations of this Court made in the case of Khan Asfandyar Wali v. Federation of Pakistan (PLD 2001 SC 607). However, till such fresh appointments are so made, the present incumbents may continue to discharge their obligations strictly in accordance with law. They shall, however, transmit periodical reports of the actions taken by them to the Monitoring Cell of this Court which is being established through the succeeding parts of thisjudgment;
(xii) that a Monitoring Cell shall be established in the Supreme Court of Pakistan comprising of the Chief Justice of Pakistan or a Judge of the Supreme Court to be nominated by him to monitor the progress and the proceedings in the above noticed and other cases under the NAB Ordinance. Likewise similar Monitoring Cells shall be set up in the High Courts of all the Provinces comprising of the Chief Justice of the respective Province or Judges of the concerned High Courts to be nominated by them to monitor the progress and the proceedings in cases in which the accused persons had been acquitted or discharged under Section 2 of the NRO;
(xiii) that the Secretary of the Law Division, Government of Pakistan, is directed to take immediate steps to increase the number of Accountability Courts to ensure expeditious disposal of cases;

Quaid-i-Azam's Speech On the occasion of the Opening Ceremony of The State Bank of Pakistan

"Mr. Governor, Directors of State Bank, Ladies and Gentlemen.
The opening of the State Bank of Pakistan symbolises the sovereignty of our State in the financial sphere and I am very glad to be here today to perform the opening ceremony. It was not considered feasible to start a Bank of our own simultaneously with the coming into being of Pakistan in August last year. A good deal of preparatory work must precede the inauguration of an institution responsible for such technical and delicate work as note issue and banking. To allow for this preparation, it was provided, under the Pakistan Monetary System and Reserve Bank Order, 1947, that the Reserve Bank of India should continue to be the currency and banking authority of Pakistan till the 30th September, 1948. Later on it was felt that it would be in the best interests of our State if the Reserve Bank of India were relieved of its functions in Pakistan, as early as possible. The State of transfer of these functions to a Pakistan agency was consequently advanced by three months in agreement with the Government of India and the Reserve Bank. It was at the same time decided to establish a Central Bank of Pakistan in preference to any other agency for managing our currency and banking. This decision left very little time for the small band of trained personnel in this field in Pakistan to complete the preliminaries and they have by their untiring effort and hard work completed their task by the due date which is very creditable to them, and I wish to record a note of our appreciation of their labours.
As you have observed, Mr. Governor in undivided India banking was kept a close preserve of non-Muslims and their migration from Western Pakistan has caused a good deal of dislocation in the economic life of our young State. In order that the wheels of commerce and industry should run smoothly, it is imperative that the vacuum caused by the exodus of non-Muslims should be filled without delay. I am glad to note that schemes for training Pakistan nationals in banking are in hand. I will watch their progress with interest and I am confident that the State Bank will receive the co-operation of all concerned including the banks and Universities in pushing them forward. Banking will provide a new and wide field in which the genius of our young men can find full play. I am sure that they will come forward in large numbers to take advantage of the training facilities which are proposed to be provided. While doing so, they will not only be benefiting themselves but also contributing to the well-being of our State.
I need hardly dilate on the important role that the State Bank will have to play in regulating the economic life of our country. The monetary policy of the bank will have a direct bearing on our trade and commerce, both inside Pakistan as well as with the outside world and it is only to be desired that your policy should encourage maximum production and a free flow of trade. The monetary policy pursued during the war years contributed, in no small measure, to our present day economic problems. The abnormal rise in the cost of living has hit the poorer sections of society including those with fixed incomes very hard indeed and is responsible to a great extent for the prevailing unrest in the country. The policy of the Pakistan Government is to stabilise prices at a level that would be fair to the producer, as well as the consumer. I hope your efforts will be directed in the same direction in order to tackle this crucial problem with success.
I shall watch with keenness the work of your Research Organization in evolving banking practices compatible with Islamic ideas of social and economic life. The economic system of the West has created almost insoluble problems for humanity and to many of us it appears that only a miracle can save it from disaster that is not facing the world. It has failed to do justice between man and man and to eradicate friction from the international field. On the contrary, it was largely responsible for the two world wars in the last half century. The Western world, in spite of its advantages, of mechanization and industrial efficiency is today in a worse mess than ever before in history. The adoption of Western economic theory and practice will not help us in achieving our goal of creating a happy and contended people. We must work our destiny in our own way and present to the world an economic system based on true Islamic concept of equality of manhood and social justice. We will thereby be fulfilling our mission as Muslims and giving to humanity the message of peace which alone can save it and secure the welfare, happiness and prosperity of mankind.
May the Sate Bank of Pakistan prosper and fulfil the high ideals which have been set as its goal.

Who Messed Up Afghanistan: Pakistan Or The United States?

‘It is Pakistan that needs to complain, and complain loudly’

An Interview with Ahmed Quraishi, by Jason Miks

The Diplomat speaks with Pakistani commentator Ahmed Quraishi about the country’s current military offensive in Waziristan, relations with the US and what America should do to improve its image in Pakistan.

US Secretary of State Hillary Clinton was in Pakistan this month meeting key political leaders. What did you make of her comment that she finds it difficult to believe that nobody in the Pakistani government knows the whereabouts of top al-Qaeda members?

Ahmed Quraishi: It was very surprising to even the most hardened skeptics here in Pakistan to hear a US secretary of state saying this, because despite all we heard during the eight years of President [George W.] Bush and Vice President Dick Cheney, no American official accused Pakistan or ‘rogue elements’ in the country of supporting or protecting al-Qaeda. If ever there were any grievances with Pakistan on this count, they were mostly focused on that Pakistan had done a very good job of cooperating with the Americans on al-Qaeda, but that progress was still lacking on the Afghan Taliban and its leadership. So in the entire eight years since September 11, no US official actually criticized Pakistan by saying Pakistan was somehow trying to protect al-Qaeda.

Second, the facts contradict what the secretary of state said. Everybody knows the vast number of al-Qaeda operatives that have been arrested have been arrested in Pakistan. And the big fish names, although there is close cooperation between the CIA and ISI [Inter-Services Intelligence], were arrested thanks to crucial information coming from Pakistani intelligence sources. This is, of course, natural seeing as it is our country, and it’s only to be expected that the ISI and other Pakistani government agencies should be at the forefront of finding these people. And they did.

And three, another crucial point is that if we’re going to throw blame at each other, then frankly speaking it is Pakistan that needs to complain--and complain loudly--at the failure of US intelligence and the US military back in late November and early December 2001 to corner and arrest Osama bin Laden. If you remember the battle in Tora Bora on the border between Afghanistan and Pakistan, that battle was instrumental at providing an escape route to the al-Qaeda chief and his liuetenanats. And the biggest blame for that actually goes to US intelligence, which relied on unreliable Afghan warlords on the ground who apparently took money, probably from al-Qaeda operatives, and let Osama bin Laden escape.

So if anyone should be complaining it should be the Pakistanis, who now have to deal with this country’s mess, basically because many of these people who should have been eliminated in Afghanistan were able to disperse and mostly head for Pakistan. And this is mostly because of the thin American presence in Afghanistan, the poorly secured military presence in that country and of course the poorly secured border.

One of the reasons Secretary Clinton was visiting was to try and improve the US image in Pakistan. How much of an image problem does the US have there?

Quraishi: In this whole debate about America’s image in Pakistan, and people talk of course about how America supported a military dictator [General Pervez Musharraf] and so forth, the reality is that the real grievances pertain to issues that are not really discussed very openly, especially in the American media, and which are not really known about by American public opinion. I’m talking about things like, for example, the fact that the US military and the Afghan army, which is being trained by the US army, suddenly removed all their posts from the Afghan side of the border when Pakistan began its military operation in South Waziristan.

This isn’t the figment of anyone’s imagination--it has been verified by people on the ground and was raised by the Pakistani chief with General Stanley McCrystal a couple of weeks back. This story was headline news on major Pakistani news channels and in newspapers, so it’s surprising that so little time has been given over to such grievances, which provide fodder to skeptics in Pakistan who question US motives in Afghanistan.

And of course we have a standing complaint that weapons and money that are sustaining terrorists are coming from Afghanistan. And it’s not just the factor of Afghan warlords and drug money and so forth. It’s beyond that. And we feel little time is given to this grievance in the US media. US officials know about it, and often discuss the issue with Pakistani officials, but they never talk about this openly. So I find it very funny when Secretary Clinton comes over here and says ‘you have some questions about our role, and we have some grievances about yours, but we need to reach some common ground.’ Sure. But this entire thing that is going on in the Af-Pak region is a result of US policy. And eight years on, this project is falling apart and isn’t showing any signs of being nearer a conclusion than it was, say, five years ago. So serious questions are arising about why in Pakistan we continue to be part of a project that shows every signs of failing, if it has not already failed.

What would you like to see the US doing differently to improve its image?

Quraishi: Two things. One is that in terms of foreign policy, on its policy on Afghanistan, it needs to take its Pakistani ally along as it moves on. What has happened over the past eight years is that Pakistan was not taken along in US planning on Afghanistan. A government was set up in Kabul that was decidedly full of anti-Pakistan elements, elements that are antagonistic to Pakistan. Now when I say this I don’t mean that the Afghan government should be pro-Paksitan. But they should not be antagonistic. So the United States and the different stakeholders in policy in Afghanistan, including the intelligence community and the military, will have to trust Pakistan and take it along as an ally, and not treat it as someone to be looked upon with suspicion, or to be used for logistical help it needs but to then not trust it on the long-term questions of what kind of government should be in Kabul and whether the Pashtuns need to be isolated from such a government or not.

Number two, the United States needs to understand that it is counter productive to try and interfere in the domestic politics of Pakistan. Very few observers in the United States discuss a very interesting thing that they have been doing in Pakistan, which is to try and micromanage that country. The very government we have in Pakistan right now, the elected government in Islamabad, wouldn’t have been in place without a deal that was discussed and tailored and finalized at the US State Department with the active participation of diplomats from the United States and United Kingdom. And, of course, with the full backing of Vice President Cheney at that time. That deal resulted in tailoring the political set up that you currently see in Pakistan, and it dealt with such minute issues as who would be the coalition partner, which parties could work with the United States, and which ones could not.

So this kind of micromanagement has really backfired--when the United States was tailoring this kind of deal with Musharraf, the anti-Americanism in Pakistan was not at a level it is at right now. So this tells you something at least about how the micromanagement has backfired and has produced possibly an exaggerated feeling of a threat among the ordinary Pakistani on the street.

As you mentioned, the Pakistani military recently embarked on a major offensive in Waziristan. What do you think the prospects for success are?

Quraishi: There’s no question that a ragtag army of mountain fighters who do not enjoy the full support of the people of the area they are based in--the people of that area are pouring into other parts of Pakistan where temporary camps have been set up for as long as this military operation goes on--that such a militia cannot sustain itself in the face of a large and well-organized army.

Of course, when the Pakistan army began the Swat operation in the spring of this year, there was a lot of skepticism--especially when almost 2 million people from that area poured into refugee camps, people were asking how that problem would be dealt with. But now, over 1.5 million people have been restored to their towns and villages in the Swat region, and that region is overwhelmingly secure now.

There’s no reason why this can’t be replicated in South Waziristan. It’s a small patch of land. The only uncertainty we really have is over the Afghan side of the border--there aren’t enough Afghan soldiers on that side, and there are no US military or ISAF on the other side. This is a constant problem and we know money and weapons are coming through from that side. The Mehsud terror militia is not sustaining itself from inside Pakistan. I understand that Pakistani officers have had assurances from General McCrystal that he will do what he can with the resources he has in Afghanistan to secure that area and ensure that such movement doesn’t occur backward and forward. But we’ll have to wait and see. At the moment though, the prospects look good.

To Pentagon’s Pakistani Adviser Ahmed Rashid: What’s Wrong With Pakistan’s Interests?

The famous Afghan expert is now peddling his Pentagon bias as fair analysis. My question to him is this: fine if you justify US interest, but what’s wrong if Pakistan has its interests too?



ISLAMABAD, Pakistan—Mr. Ahmed Rashid’s part-time job as an advisor to the US military on Afghanistan is beginning to overshadow his otherwise impeccable analysis.

As a journalist, Mr. Ahmed Rashid witnessed firsthand in Afghanistan the intrigues by several nations inside that country during the 1980s and '90s.

But here, in his BBC.com article titled, Pakistan conspiracy theories stifle debate, Mr. Rashid insists that the entire mess in Pakistan is self-inflicted and is free of any outside interest and influence.

His close contacts with Washington, and especially with the military establishment there, should not blind him to the clear signs of how Afghan soil is being used against Pakistan, and against its military to be more precise, in retaliation for the twisted perception that Pakistan is somehow behind the Afghan Taliban resurgence and the resulting US military and intelligence failures in that country.

While owning our part of the mess, we in Pakistan need to be very clear on those parts of the mess that the United States is responsible for.

Washington began its double game with Pakistan immediately after overthrowing the Afghan Taliban government.

The United States worked from the start to create a very anti-Pakistan setup in Kabul. The Indians have been given a lot of space in Afghanistan. In fact, parts of the US intelligence and military decided quite early in the Afghan campaign that Indian 'expertise' will shape American views on Afghanistan and on how to deal with Pakistan, in itself the first breach on the part of US over what was supposed to be a Pakistani-American alliance to stabilize Afghanistan. The composition of the puppet Afghan government, the collective punishment against the Pashtuns, and the way things panned out in the country over the past seven years support this conclusion.

Of course, the word ‘signs’ is an understatement now considering the piles of hard evidence that Pakistani political and military officials have been confronting the Americans with recently. This evidence proves American culpability in not only messing up Afghanistan but also Pakistan. This evidence includes material that shows how the Indians and Mr. Karzai's spymasters create and support terrorism against Pakistan. It also shows how CIA is turning a blind eye, and in some other instances actually supports terrorism inside Pakistan.

Yes, Pakistan and Pakistanis are responsible for creating a weak state, burdened by an unworkable form of democracy. We Pakistanis have created a situation that is now providing several openings for outsiders to wreak havoc inside our country and manipulate our politics.

The February 2008 elections in Pakistan could have been an opportunity for Pakistanis to reassert themselves and chart out a new course in domestic and foreign policies. Here again the United States and the United Kingdom colluded to force on Pakistanis one of the most corrupt and inept governments in the country’s history.

As such, Washington and London are responsible for the latest political mess in Pakistan, since both helped create a secret 'deal' that resulted in forming a Pakistani government led by a dream team of Pakistan's most corrupt individuals.

Ethnic or religious insurgencies never existed in Pakistan before 2004. These insurgencies surfaced and gained momentum thanks to the mess in Afghanistan and the intrigues of some of our so called allies and friends.

This anti-Pakistan wave of terrorism armed and financed from the Afghan soil has an objective: the Pakistani military.

Pakistani military is too big and too strong for American and British plans for the region. In these plans, India is supposed to provide cheap or low cost soldiers and

For Mr. Rashid to simply dismiss legitimate Pakistani grievances is absurd, to say the least.

The second part of his op-ed is a passionate and at times desperate defense of the PPP government in Islamabad. Nothing surprising here. This government is even more pro-US than the Musharraf government. Mr. Rashid, of course, believes that any US plans for Afghanistan and the region supersede any conflicting – but legitimate – Pakistani interests.

By defending this Pakistani government and dismissing the legitimate Pakistani grievances that run contrary to US interest, Mr. Rashid betrays his own political bias, which he tries in this op-ed to peddle as fair and balanced analysis.

Pakistanis are fed up with fighting other people's wars and conforming to other people's agendas in the region.

Pakistan has its own agenda. This Pakistani agenda is rising up from this mess and is making itself felt in multiple ways. And this agenda will eventually supersede anything that foreign powers try to impose through unnatural means. It is better for Mr. Rashid and those who share his views to understand this before it is too late.
